NOTICE TO USER: PLEASE READ THIS AGREEMENT CAREFULLY. By accessing or using this Site in any way, including, without limitation, use of any of the Services, downloading of any Materials, or merely browsing the Site, you agree to and are bound by the Terms of Use.
1. Acceptance of Terms
AvScholars Publishing (“AvScholars”) makes the FinancialAidScholarshipWorkshop.com Web site (the "Site"), including all information, documents, communications, files, text, graphics, software, and products available through the Site (collectively, the "Materials") and all services operated by AvScholars and third parties through the Site (collectively, the "Services"), available for your use subject to the terms and conditions set forth in this document and any changes to this document that AvScholars may publish from time to time (collectively, the "Terms of Use").
AvScholars reserves the right to change the Terms of Use and other guidelines or rules posted on the Site from time to time at its sole discretion, and will provide notice of material changes on the home page of the Site. Your continued use of the Site, or any Materials or Services accessible through it, after such notice has been posted constitutes your acceptance of the changes. Your use of the Site will be subject to the most current version of the Terms of Use, rules, and guidelines posted on the Site at the time of such use. You should periodically check the "Terms of Use" link on the Site's home page to view the then-current terms. If you breach any of the Terms of Use, your authorization to use this Site automatically terminates, and any Materials downloaded or printed from the Site in violation of the Terms of Use must be immediately destroyed.
2. Definitions.
The following definitions are applicable to this License Agreement:
"AvScholars" means AvScholars Publishing, 6316 Garden View Lane, Matteson, IL 60443, and its licensors, if any, which is the entity granting this license to You under the terms and conditions of this License Agreement.
"License Agreement" means either the Single-User, Multiple-User, or Site License Agreement which contains AvScholars' terms and conditions for the use of the Software.
"Computer" means a virtual or physical computer device that accepts information in digital or similar form
and manipulates it for a specific result based on a sequence of instructions.
"Software" refers to the Financial Aid and Scholarship Workshop (eLearning Course) which means (a) all of the information with which this License Agreement is provided, including but not limited to (i) AvScholars or third party software files and software and other computer information; (ii) sample and stock photographs, images, sounds, clip art and other artistic works bundled with AvScholars software and not obtained from AvScholars or another party through a separate service ("Content Files"); (iii) related explanatory written materials and files ("Documentation"); and (iv) and any modified versions and copies of, and upgrades, updates and additions to, such information, provided to You by AvScholars at any time, to the extent not provided under a separate agreement (collectively, "Updates").
"You/Your" means the individual or entity (referred to as the End User) who purchased the Software and who is entering into this License Agreement.
"INSTALL" means to copy the Software to a hard disk drive or similar storage device.
"USE" means to access, install, run, display, download, copy or otherwise benefit from using the functionality of the Software.
"PRODUCT MEDIA" refers to the medium in which or on which the Software is embodied or contained, whether on a disk(s), CD-ROM(s), digital file(s), or pursuant to technology now known or hereinafter developed.
"Updates" means updates, upgrades, enhancements or improvements to the Software.
"Internal Network" means a private, proprietary network resource accessible only by individuals of a specific organization, corporation or similar business entity. Internal Network does not include portions of the Internet or any other network community open to the public, such as membership or subscription driven groups, associations and similar organizations.
3. Grant of Multiple-Users License
The Multiple-Users License is for approved educational institutions and non-profit 501(c)(3) organizations to purchase additional Single-User Licenses of the Financial Aid and Scholarship Workshop (Online Course) at a deeply discounted price for their students. An online account must be purchased for each authorized user; and each user must comply with the Single-User License Agreement. The Multiple-Users License is licensed on a per-online user basis. The license is not a concurrent-use license. Multiple-User Licenses are only available directly from AvScholars; and may not be obtained through purchase from any other source.
A Multiple-Users License allows your educational institution to register a specified number of licensed copies of authorized users for The Financial Aid and Scholarship Workshop (Online Course), in accordance with this License Agreement. Each user at your educational institution under the Multiple-Users License Agreement will have a separate online account for The Financial Aid and Scholarship Workshop (Online Course).
All educational institutions and non-profit 501(c)(3) organizations must comply with the terms and conditions of the Single-User License Agreement and the Online Terms of Use for the Online Course. (Link)
4. Administration and Distribution of the Online Course
The Multiple-Users License must be centrally administered within your educational institution to your students, which means that there needs to be one employee within your educational institution who acts as the contact administrator and is AvScholars’ point of contact for your institution.
At the time of purchase, or upon acceptance of the purchase order by AvScholars, the contact administrator will receive an email notification that will include instructions on how to register their authorized users for the online course.
Your contact administrator is responsible for submitting your institution’s roster of authorized users for the online course to AvScholars Publishing with 5 business days from date of purchase, and for adding on to the size of the license when necessary if the number of authorized users at your institution needs to be increased.
5. Single-User License
The Single-User License Agreement and Online Terms of Use of The Financial Aid and Scholarship Workshop (Online Course) are made part of and incorporated by reference into this Multiple-Users License Agreement. By accepting this Multiple-Users License Agreement, You and Your Authorized Users are also accepting the additional terms and conditions of the Single-User License Agreement and/or the Single-User Online Terms of Use Agreement, if any, set forth therein.

6. Fees and Payment
6.1 Your institution shall pay to AvScholars the Multiple-Users License fee for the specified number of authorized users for the software version and/or the online course, which is specified on this website, order form, and/or purchase order. Your institution’s payment shall be payable in advance or within thirty (30) days from the date set forth on the AvScholars invoice.
6.2 Payment of the Fees must be made in U.S. dollars, and must be paid via credit card, direct withdrawal from a bank account, or approved purchase order. You grant AvScholars the right to charge the credit card or bank account specified in the applicable Order Form for all Fees incurred under this Agreement. You represent and warrant that if you are purchasing something from AvScholars Publishing that (i) any credit information you supply is true and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes.
6.3 On the Effective Date, You will remit to AvScholars Publishing a one-time payment of the Fees as set forth on the Order Form based on the number of Authorized-Users License you are purchasing.
All Fees are non-refundable. Your obligation to pay Fees not subject to a reasonable dispute will be unconditional and not subject to abatement, setoff or defense of any kind.

6.5 All payments are exclusive of any tariffs, duties or taxes imposed or levied by any government or governmental agency. Licensee shall be liable for payment of all such taxes, however designated, levied or based on Licensee’s possession or use of the Software or Online Course on this License Agreement, including without limitation, state or local sales, use, value-added and personal property tax, but excluding any tax on the net income of AvScholars.
6.6 Any payment required hereunder that is made late (including unpaid portions if incomplete payment) will accrue interest at 18% per annum (1.5% per month) or the maximum rate permitted by applicable law, whichever is less, from the due date until paid. The parties also agree as follows:(a) Any payment received more than thirty (30) days after becoming due shall be deemed "late" for purposes of this paragraph; and (b) Any interest charged or paid in excess of the maximum rate permitted by applicable law shall be deemed the result of a mistake and shall be credited or refunded (at AvScholars’ option) to Licensee.
6.7 Educational institutions may request a license at anytime during the year.
6.8 You may, at any time during the term of the Agreement, increase the number of licenses which you have purchased upon providing written notice to AvScholars Publishing, together with payment of AvScholars Publishing’s then-current Fees associated with such number of additional Authorized-User licenses.
6.9 Your institutions’ authorized users for the software version and online course are responsible for any charges associated with accessing the Online Course, including but not limited to computer equipment, telephone or Internet connections and access to software.
